The agreement
These terms are between you and Simple Mailers Inc., of 2261 Placeholder St, Suite 100, San Francisco, CA 94114 ("we", "us"). By creating an account or asking us to send mail on your behalf, you accept them. Questions go to hello@simple-mailers.com.
What we do
We take a list of your existing clients or patients, produce printed cards and matching email or SMS where you have enabled them, and deliver them through the postal service and our messaging providers. We handle creative, printing, addressing and postage.
Your list, your responsibility
You keep ownership of the records you give us. You confirm that you have the right to send those people commercial mail and messages, and that anyone who has opted out has been removed before you send us the list.
You are responsible for the accuracy of the records. We verify addresses against postal data and will tell you what fails, but we cannot fix a record that was wrong at source.
What you may not send
No clinical or diagnostic detail, no content that identifies a medical condition, nothing unlawful, misleading, or discriminatory, and nothing you do not hold the rights to. We may refuse or stop any campaign that breaches this, and will tell you why.
Credits, pricing and minimum spend
Cards start as low as $1.20 each, including print, addressing and postage. Exact rates depend on format and volume and are confirmed before a campaign runs.
New accounts receive $100 in credits at no charge, roughly 100 cards. Credits have no cash value, are not refundable or transferable, and expire twelve months after issue.
After the credits, accounts run on a minimum spend of $200 per month, which covers the integration, managed creative and reporting. Unused minimum spend does not roll over.
Cancelling
You can cancel at any time with 30 days' notice, which ends the minimum spend at the close of the following cycle. Campaigns already in production cannot be recalled once they are with the printer or the postal service.
Delivery
We control when mail is handed to the postal service. We do not control what the postal service does next, and we cannot guarantee delivery dates. Where a card is undeliverable through our error, we reprint and remail it at no charge; where it is undeliverable because the address you supplied was wrong, we do not.
Results
We do not promise a response rate, a number of bookings, or any particular return. Any figures we publish are industry ranges or illustrations, not forecasts of your result.
Liability
Nothing here excludes liability that cannot lawfully be excluded. Otherwise our total liability in any twelve-month period is limited to the fees you paid us in that period, and neither party is liable for indirect or consequential loss.
Changes
We may update these terms. Where a change materially affects your rights or the price, we will give at least 30 days' notice by email before it takes effect.
